While the noble cannabis plant has, indeed, been liberated from a great many onerous and oppressive legislative burdens of late, there are still a couple of states which stubbornly refuse to let go of their antiquated policies.
Federal vs. State Law
Under the provisions of the 2018 Farm Bill, it is federally legal for us to ship our products to all 50 United States. That glorious bill explicitly mandates the free and unhindered transport and shipment of all of our products.
However, the Farm Bill is enforceable only on the federal level; and, as such, is liable to being superseded by state law. Each state has the discretionary power to override the Farm Bill.
In our home state of Pennsylvania, we are fortunate to enjoy the auspices of a regulatory climate that is friendly to our industry. There is a small chance that your state may not be so friendly. 🤦🏻
Let not your heart be troubled
This needn’t be an anxiety ridden process for you. According to our legal counsel, there are only a couple of states where this may even be an issue; and even in those rare instances, they say the law is either not clearly defined, or, potentially, even unenforceable. (This statement does not constitute legal advice!)
It should be easy to find out what the laws are in your jurisdiction. Just ask a cop, “Hey, are you guys persecuting… umm, I mean, arresting people for hemp?”
